Welcome to To my niece, By accessing or making a purchase on the website www.tomyniece.com or at any of our stores, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before purchasing from the Site or our stores.

If you do not agree with these Terms, you should immediately cease using the Site and Services. These Terms apply to all visitors, users, and others who access or use the Site and Services.

By accessing and using the Site and purchasing, you agree to these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference. We reserve the right to update or change these Terms at any time without prior notice. Your continued use of the Site and Services after any such changes constitutes your acceptance of the new Terms.

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing the offending content and terminating the accounts of users who engage in such conduct.

5. Intellectual Property

  • Ownership: All content, features, and functionality on the Site, including but not limited to text, graphics, logos, images, videos, audio, trademarks, service marks, and software, are owned by To my niece or its licensors and are protected by copyright, trademark, and other intellectual property laws.

  • License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and Services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works of any content from the Site without prior written consent from To my niece.

  • User-Generated Content: If you submit, upload, or post content (such as reviews, comments, or other materials) on the Site, you grant To my niece a worldwide, royalty-free, perpetual, irrevocable, and transferable license to use, modify, distribute, and display such content in connection with the Site and Services.

  • Product Availability: All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to modify or discontinue products or services at any time, and we are not liable for any such changes.

  • Orders: When you place an order on the Site, you agree to pay for the products ordered. We reserve the right to refuse or cancel any order at our discretion, including but not limited to instances where there is an error in the pricing or availability information.

  • Payment: Payments for products are processed through third-party payment processors. You agree to provide accurate and complete payment information when making a purchase. By submitting payment information, you authorize us to charge the applicable fees to your designated payment method.

  • Orders once placed cannot be cancelled nor any changes can be done to the outfit, the amount is non-refundable nor can it be converted into a credit note or adjusted against any other order/outfit. In case clients wants to cancel, the amount paid stands to be forfeited. 

7. Pricing and Payment for international shipments

  • Pricing: All prices listed on the Site are in your currency, unless otherwise specified. Prices are subject to change without notice, and we reserve the right to update product pricing at any time. Please note that the prices displayed may not include taxes, customs duties, or shipping fees, which will be calculated at checkout.

  • Taxes and Duties: For international customers, the price of your order may not include taxes, customs duties, or fees that may be applied by your country. These additional charges are the responsibility of the customer. You should check with your local customs office or tax authority for more information regarding potential import taxes or customs duties before making a purchase.

  • Payment Methods: We accept a variety of international payment methods, including:

  • Order Confirmation: Once your payment is successfully processed, we will send you an order confirmation email with details about your purchase, including order number, item details, and shipping information. If you do not receive this confirmation, please contact us to verify the status of your order.


7A. Pricing and Payment for INDIAN users

Pricing: All prices listed on the Site are in Indian Rupees (INR) unless otherwise stated. Prices are subject to change without prior notice. The total amount charged will include product prices, applicable taxes, and any shipping fees.

Taxes: The prices displayed on the Site include Goods and Services Tax (GST), where applicable. The applicable GST rate will be included in the final price at checkout. If there are any changes to GST or other tax rates, the prices will be updated accordingly.

Payment Methods: We accept a variety of secure payment methods for domestic orders within India, including:

  • Credit and Debit Cards: We accept major Indian credit and debit cards, including Visa, MasterCard, and RuPay.

  • UPI (Unified Payments Interface): You can make payments via UPI using popular apps like Google Pay, PhonePe, Paytm, or any other UPI-based application.

  • Net Banking: Payments via Internet Banking from major banks like HDFC, ICICI, SBI, Axis Bank, and others are accepted.

  • Wallets: We accept payments via popular Indian digital wallets such as Paytm, PhonePe, and Google Pay (wallet options may vary depending on your location).

  • Cash on Delivery (COD): For certain areas, we offer the option of paying cash upon delivery. Please check if COD is available in your location during checkout.


Security: All payments are processed through secure third-party payment gateways. We do not store your credit card or sensitive payment information. Payment details are encrypted and handled with the highest security standards to protect your privacy.

8. Shipping and Delivery

  • Shipping terms, including delivery times and fees, are provided at checkout and are subject to change based on availability and location. We make every effort to process and ship orders promptly, but we are not responsible for delays caused by third-party carriers, customs, or other factors beyond our control.

  • To my niece only facilitates the delivery through reliable courier services and is not liable for any damages in transit, couriers are solely at customer’s risk.


9. Exchange and Returns

  • Refund Policy: Please note that we do not offer refunds under any circumstances. All sales are final, and we encourage you to review your order carefully before making a purchase. We provide exchanges only in very specific situations outlined in our exchange policy page. By purchasing from To my niece, you agree to these terms.

  • Damaged or Defective Products: If you receive a damaged or defective product, please contact us immediately. We will arrange for an exchange based on the situation, provided if the un-cut unboxing video is shared by the client and verifies the claim.

10. Disclaimers and Limitations of Liability

  • No Warranty: The Site and products are provided "as is" and without warranty of any kind, either express or implied, including but not limited to warranties of merchantability or non-infringement.

  • Limitation of Liability: To the fullest extent permitted by law, TO MY NIECE shall not be liable for any direct, indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from your use or inability to use the Site or purchasing products, even if we have been advised of the possibility of such damages.

  • Indemnification: You agree to indemnify, defend, and hold harmless TO MY NIECE, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Site or violation of these Terms.

13. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, claim, or controversy arising out of or in connection with these Terms or order placed shall be subject to exclusive jurisdiction of the courts in SAS Nagar, Mohali, Punjab.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and TO MY NIECE regarding the use of the Site and Services.

17. Order Collection & Delivery Policy

Customers are required to collect their order or receive the parcel within 25 days from the scheduled delivery date or trial date at the store, as communicated by To My Niece private limited.
Failure to do so will result in the brand reserving the right to:
• Cancel the order without prior notice, and
• Move the product back to our warehouse inventory.

18. Partial COD Orders


To My Niece offers a Partial Cash on Delivery (“Partial COD”) facility for select orders. Under this service, customers are required to pay 30% of the total order value in advance to initiate order processing.

Please note:
1. The advance amount paid under the Partial COD facility is non-refundable, non-transferable, and non-adjustable against any other order, design, or credit note.
2. Once an order has been confirmed and the partial payment has been made, no cancellations, modifications, or refusals at the time of delivery shall entitle the customer to any refund or adjustment of the advance amount.
3. Orders placed under the Partial COD facility may require additional processing and dispatch time as compared to prepaid orders. Customers requiring urgent deliveries are advised to opt for prepaid orders to ensure timely dispatch.
4. All other clauses under To My Niece’s No Exchange / No Return Policy shall apply in full to Partial COD orders.

By placing an order with To My Niece, whether prepaid or under the Partial COD facility, the customer acknowledges and agrees to be bound by all the terms and conditions outlined in this Refund & Exchange Policy and any other applicable policies of To My Niece.

No refunds, exchange, or credit notes will be applicable in such cases. To my niece pvt. Ltd.  holds no responsibility for follow-up communication once the stipulated collection period has lapsed.
